Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and David Botha trading as Static Syntax, operating the Discretio service (“we,” “us,” or “our”), regarding your use of the Discretio website, application, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

Service Description

Discretio is a micro-journaling application based on Stoic philosophy. The Service provides daily Stoic reflection prompts, guided and unguided journaling modes, mood tracking, streak tracking, and personal insights and analytics. The Service is designed to support your daily reflection practice and is not a substitute for professional advice.

Service Availability and Pricing

Discretio offers two paid subscription tiers: Basic and Premium. The Basic plan includes core journaling functionality such as daily Stoic prompts, guided and unguided modes, streak tracking, activity calendars, and entry history. The Premium plan includes additional features such as mood tracking, analytics and insights, writing statistics, and PDF export.

We may modify pricing, features, or subscription tiers at any time. If we make changes that affect your current plan, we will provide notice to existing users. You will not be charged without your explicit consent.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Transmit harmful, offensive, or inappropriate content
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated systems (bots, scrapers) without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any commercial purpose without our consent
  • Impersonate any person or entity

User Content

Your Content

You retain all ownership rights to the journal entries and content you create using the Service (“User Content”). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.

Your journal entries are encrypted at rest using AES-256-GCM encryption. This means your content is stored in an encrypted format and is only decrypted when needed to display it to you.

Content Responsibility

You are solely responsible for your User Content. We do not endorse, verify, or guarantee the accuracy of User Content. You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any laws or third-party rights
  • Your User Content does not contain viruses or malicious code

Intellectual Property

The Service, including its design, features, code, and content (excluding User Content), is owned by Discretio and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

“Discretio” and our logo are identifying marks of our service. You may not use them in a way that creates confusion about the source of our Service.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

Service Disclaimers and Liability Limits

No Guarantees

We provide the Service “as is” without guarantees of any kind. While we work hard to keep Discretio reliable and secure, we cannot promise that it will always be available, error-free, or completely secure. Like all software, things can occasionally go wrong.

Not Professional Advice

Discretio is a journaling tool rooted in Stoic philosophy. It is not a substitute for professional medical, mental health, legal, or financial advice. If you need professional help, please consult a qualified professional. In emergencies, call emergency services immediately.

Liability Limits

To the maximum extent permitted by law, our liability for any issues with the Service is limited. We are not responsible for indirect damages, lost profits, or other intangible losses that may result from:

  • Your use or inability to use the Service
  • Security breaches or unauthorized access to your content
  • Actions or content from other users
  • Data loss or service interruptions

If we are found liable for something, our total liability is capped at the amount you paid us in the 12 months before the issue, or $100 (whichever is greater).

These limits are standard for online services and allow us to provide Discretio at an affordable price.

Indemnification

You agree to indemnify, defend, and hold harmless Discretio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and User Content
  • You remain responsible for all fees incurred prior to termination
  • Provisions of these Terms that should survive termination will remain in effect

You may terminate your account at any time through the account settings or by contacting us at hello@discretio.app.

Dispute Resolution

If you have a dispute with us, please contact us first at hello@discretio.app. We'll work in good faith to resolve any issues informally. Most concerns can be addressed through direct communication.

If we cannot resolve a dispute informally, either party may pursue resolution through applicable small claims court or other appropriate legal channels.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any legal disputes will be resolved in accordance with the laws applicable to online services in your jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Discretio regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
